Terms of Service

1. Acceptance of Terms

By accessing or using My Diabetes Friend ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service.

2. Description of Service

My Diabetes Friend is a health tracking application that:

• Integrates with Dexcom continuous glucose monitors (CGMs)
• Integrates with WHOOP and Oura Ring wearable devices
• Analyzes patterns between glucose levels, sleep, recovery, and other health metrics
• Provides personalized insights based on your historical data
• Offers optional anonymized community benchmark comparisons (off by default)
• Offers optional menstrual cycle tracking for users who may experience hormonal impacts on glucose

3. Eligibility

You must be at least 18 years old to use the Service. If you are between 13-17 years old, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

5. Subscription & Payments

5.1 Friend (Free Tier): Basic features are available at no cost.

5.2 Paid Subscriptions: Premium features require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.3 Free Trial: We may offer a free trial period. At the end of the trial, you will be automatically charged unless you cancel before the trial ends.

5.4 Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

5.5 Price Changes: We reserve the right to change prices with 30 days notice. Existing subscribers will be notified before any price increase takes effect.

6. Health Data & Privacy

6.1 Data Collection: We collect health data from your connected devices (Dexcom, WHOOP, Oura) solely to provide the Service. See our Privacy Policy for details.

6.2 Data Ownership: You retain ownership of your health data. We do not sell your personal health information to third parties.

6.3 Data Security: We implement industry-standard security measures to protect your data, including encryption and secure authentication protocols.

6.4 Optional Benchmark Feature: If you enable Community Benchmark Insights, your data may be used to generate anonymized and aggregated cohort-level comparisons shown in-app. This feature is optional, disabled by default, and can be turned off at any time.

7. Medical Disclaimer

THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.

The insights and recommendations provided by My Diabetes Friend are based on statistical analysis of your personal data and are not medical advice. The Service:

• Does NOT replace your continuous glucose monitor's alerts or alarms
• Does NOT replace consultation with healthcare professionals
• Should NOT be used to make insulin dosing decisions without medical guidance
• May contain errors or inaccuracies in pattern detection

Always verify any insights with your own CGM data and consult your healthcare provider before making changes to your diabetes management plan.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY DIABETES FRIEND AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any health complications arising from use of or reliance on the Service
• Incorrect, incomplete, or delayed data from third-party devices
• Inaccurate pattern detection or predictions
• Any indirect, incidental, special, or consequential damages
• Loss of data or service interruptions

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless My Diabetes Friend and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Third-Party Services

The Service integrates with third-party services (Dexcom, WHOOP, Oura, Stripe). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services.

11. Intellectual Property

All content, features, and functionality of the Service are owned by My Diabetes Friend and are protected by international copyright, trademark, and other intellectual property laws.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

For EU Users: These Terms are governed by the laws of Denmark and the European Union. You have the right to bring legal proceedings in your country of residence. Nothing in these Terms affects your statutory rights under EU consumer protection laws.

For US Users: These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
